Governing Terms for Using Service Point Services and Website

These Terms and Conditions ("Agreement", "Terms", "T&C") constitute a legally binding agreement between Service Point ("Company", "we", "us", "our") and you ("User", "you", "your") regarding your access to and use of the service-point.in website, mobile applications, and all related services (collectively, the "Service"). By accessing, browsing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

These Terms are governed by the substantive laws of India, regardless of conflict of law principles. Headings are for reference only. "Including" means "including without limitation". Waiver of any term does not waive other terms.

2.1 Eligibility Requirements

By using the Service, you represent and warrant that:

  • You are at least 18 years old or the age of majority in your jurisdiction
  • You are legally authorized to enter into binding agreements

  • You are not located in a sanctioned country or on any government watchlist
  • You agree to comply with all applicable laws and regulations

2.3 Account Termination

3. SERVICE DESCRIPTION & AVAILABILITY

Service Point provides the following services (collectively, "Services"):

  • Hardware repair and replacement services
  • Other professional services as mutually agreed
3.2 Service Limitations

No Guarantee of Availability: We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be subject to downtime for maintenance, updates, or unforeseen circumstances.

Modifications: We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

3.3 Third-Party Services

The Service may integrate with third-party services and platforms. We are not responsible for third-party content, services, or policies. Your use of third-party services is subject to their respective terms and conditions.

4. USER RESPONSIBILITIES & CONDUCT

As a User, you agree not to:

  • Transmit malware, viruses, or harmful code

  • Not impersonate others or create false identities
  • Not reverse engineer or bypass security
  • Not engage in automated scraping or crawling
  • Respect rate limits and API quotas

5. INTELLECTUAL PROPERTY RIGHTS

5.1 Ownership of Service Content

All content, features, functionality, and materials on the Service (including but not limited to text, graphics, logos, images, software, code, design) are owned or licensed by Service Point and are protected by international copyright, trademark, and other intellectual property laws.

No content from the Service may be copied, reproduced, distributed, transmitted, displayed, or used in any form without prior written permission from Service Point.

5.2 User-Generated Content License

By uploading or submitting content to the Service, you grant Service Point a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purposes of providing and improving the Service.

You retain ownership of your User-Generated Content but represent and warrant that you own or have the right to license the content you submit.

5.3 Intellectual Property Infringement

If you believe your intellectual property rights have been infringed, please contact us with detailed information including infringing content location, proof of ownership, and your contact information. We will investigate and take appropriate action.

6. LIMITATIONS OF LIABILITY

LIMITATION OF DAMAGES: Except as expressly stated in these Terms or required by law, in no event shall Service Point, its directors, employees, or agents be liable for:

6.1 Liability Cap

MAXIMUM LIABILITY: Except for breaches of confidentiality obligations or infringement of intellectual property rights, the maximum aggregate liability of Service Point arising from or related to these Terms or your use of the Service shall not exceed the amount you have paid to Service Point in the 12 months preceding the claim, or INR 10,000, whichever is less.

6.2 Essential Limitations

These limitations are essential terms of this Agreement. Some jurisdictions do not allow the exclusion or limitation of liability, so some or all of these limitations may not apply to you. In such cases, our liability is limited to the maximum extent permitted by law.

7. WARRANTY DISCLAIMERS

THE SERVICE AND ALL CONTENT, FEATURES, AND FUNCTIONALITY ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SERVICE POINT EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Fitness for particular purpose
  • Non-infringement warranty
  • Accuracy and reliability
  • Uninterrupted service
  • Error-free operation
Service Guarantees

Service Point makes no warranty that:

  • Service will meet your needs
  • Service will be uninterrupted
  • Service will be error-free
  • Defects will be corrected
  • Service is secure or safe

You use the Service at your own risk and discretion. You assume all responsibility for any damage to your devices or loss of data resulting from your use of the Service.

8. PAYMENT TERMS & PRICING

8.1 Pricing & Payment

Pricing: All prices are in Indian Rupees (INR) unless otherwise specified. Prices are subject to change without notice. Any price changes will be communicated to you before they take effect.

Taxes: You are responsible for paying all applicable taxes, duties, and levies based on your jurisdiction. Service Point may collect and remit taxes on your behalf if required by law.

Payment Methods: We accept various payment methods including credit cards, bank transfers, digital wallets, and other methods as specified. Payments are processed by PCI-DSS certified payment processors.

8.2 Billing & Invoicing

Billing Cycle: For recurring services, you will be billed at the agreed frequency (monthly, quarterly, annually, etc.). Billing will continue until you cancel the service.

Non-Refundable: All payments are non-refundable except where required by law or as expressly stated in service agreements. Credits may be issued at our discretion for service disruptions.

8.3 Overdue Payments

Overdue payments may result in suspension or termination of your account and access to the Service. Late payment penalties may apply as permitted by law.

9. ACCEPTABLE USE POLICY

You agree to use the Service only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Service. Prohibited behavior includes:

Technical Violations

10. TERMINATION & SUSPENSION

10.1 Termination Rights

Your Right to Terminate: You may terminate your account and this Agreement at any time by notifying us in writing. Termination becomes effective upon our confirmation.

Our Right to Terminate: We may terminate or suspend your account and access immediately if: (a) you breach these Terms, (b) you violate applicable laws, (c) you engage in prohibited activities, (d) payment fails, or (e) we determine in our sole discretion that termination is necessary.

10.2 Effects of Termination

Upon termination:

  • Your right to use the Service terminates immediately
  • Amounts paid are non-refundable unless required by law
  • We may delete your account data after a reasonable period
  • Provisions that survive include Intellectual Property, Limitation of Liability, and Indemnification
  • We may retain data as required by law or legitimate business purposes
10.3 Suspension

We may suspend your account without prior notice if we believe you are violating these Terms or posing a risk to the Service or other users. Suspension may become permanent if not resolved within 30 days.

11. INDEMNIFICATION

Indemnification Obligation: You agree to indemnify, defend, and hold harmless Service Point, its directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from or related to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of applicable laws or regulations
  • Your User-Generated Content or data
  • Your infringement of third-party rights
  • Any harm caused to third parties through your use of the Service

12. DISPUTE RESOLUTION & GOVERNING LAW

12.1 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You agree to submit to the jurisdiction of the courts located in Patna, Bihar, India.

12.2 Dispute Resolution Process

Before initiating formal legal proceedings, the parties agree to attempt informal resolution:

  1. Good Faith Negotiation: Parties will attempt to resolve disputes through good faith negotiation for 30 days
  2. Mediation: If negotiation fails, parties may engage in mediation before a mutually agreed mediator
  3. Formal Proceedings: If mediation fails, parties may pursue litigation in Indian courts
12.3 Class Action Waiver

You agree that any legal proceedings must be brought in your individual capacity and not as a class action, class representative action, or collective action. You waive your right to participate in class actions against Service Point.

12.4 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in effect. The invalid provision will be modified to the minimum extent necessary to make it valid.

13. ADDITIONAL PROVISIONS

Entire Agreement

These Terms and Conditions, along with our Privacy Policy, constitute the entire agreement between you and Service Point regarding the Service.

Amendments

We may modify these Terms at any time. Changes become effective upon posting. Continued use constitutes acceptance.

No Waiver

Failure to enforce any provision does not constitute waiver of that provision or other provisions.

Assignment

You may not assign these Terms without consent. Service Point may assign them to successors or affiliates.
